1. Scope
The following General Terms and Conditions apply to all orders placed through my online shop.
My online shop is aimed exclusively at consumers.
Consumers are consumers within the meaning of the Austrian Consumer Protection Act
(Konsumentenschutzgesetz, KSchG) and are therefore natural or legal persons who are not
entrepreneurs.
2. Contracting party, conclusion of contract, options for correction
The purchase contract is concluded with Melanie Deike – Beyondfluidart.
The presentation of the products in the online shop does not constitute a legally binding offer,
but a non-binding online catalogue. You can first place my products in the shopping cart without
obligation and correct your entries at any time before submitting your binding order, by using
the correction tools provided and explained in the order process. By clicking the order button,
you submit a binding offer for the products contained in the shopping cart. Confirmation of
receipt of your order is sent by email immediately after you submit the order.
I accept your offer within two days by
• sending a declaration of acceptance in a separate email, or
• where applicable, the payment transaction being carried out by my service provider or the
selected payment service provider. The time at which the payment transaction is carried out
depends on the payment method selected (see "Payment").
Which alternative applies to you depends on which of the listed events occurs first.
3. Contract language, storage of contract text
The languages available for concluding the contract are German and English.
I store the contract text. The order data and these Terms and Conditions are sent to you by
email. If you have created a customer account, you can view your past orders in your account
at any time.
4. Delivery terms
4.1 Delivery area
I deliver to all member states of the European Union with the exception of Spain and Lithuania, as well as to Switzerland, Canada and the United States.
Delivery to other countries is not available through the shop. If you would like to order from outside the countries listed, please write to me at mel@beyondfluidart.com – I will gladly check on a case-by-case basis what is possible.
4.2 Shipping costs
Within Austria and the European Union, delivery is free of shipping charges. The price shown on the product page is the total price.
For deliveries outside the European Union, a flat shipping fee is charged per order. The amount depends on the country of delivery:
-
Switzerland: EUR 22.00
-
Canada: EUR 25.00
-
United States: EUR 29.00
The shipping costs applicable to your order will be shown separately during the ordering process before you place your order.
4.3 Delivery options
I ship the products to the delivery address provided during the ordering process.
I deliver by postal shipment only. Collection in person is not possible. Delivery to parcel lockers or pick-up stations is likewise not possible.
4.4 Delivery time
Every fine art print is personally signed by me and marked with its edition number before dispatch. If the motif you ordered is not in stock in the selected format, it is produced specifically for you after your order is received.
The estimated delivery time is:
-
within the European Union: 5 to 15 working days
-
Switzerland, Canada and the United States: 10 to 21 working days
This covers production, processing and shipping. Working days are Monday to Friday, excluding public holidays at the place of my registered business.
The delivery period begins on the working day following conclusion of the contract, or, where payment in advance has been agreed, on the working day following the payment instruction.
Should delivery be delayed in an individual case, I will inform you without undue delay by email and give you a new estimated delivery date. In any event, delivery will take place no later than 30 days after conclusion of the contract, unless expressly agreed otherwise.
4.5 Import charges on deliveries outside the EU
Shipments to Switzerland, Canada and the United States are imports. Import VAT, any customs duties and the carrier’s handling fee are payable by the recipient. These charges are collected on delivery and are included neither in the product price nor in the shipping costs.
The amount of such charges is determined by the regulations of the respective country of destination. They will not be reimbursed by the seller.
5. Payment
In my shop, the following payment methods are generally available to you.
Credit card
You provide your credit card details in the order process. Your card is charged immediately after
you place the order.
PayPal
In the order process, you are redirected to the website of the online provider PayPal. To pay the
invoice amount via PayPal, you must be registered there or register first, identify yourself with
your access data and confirm the payment instruction to me. After you place the order in the
shop, I instruct PayPal to initiate the payment transaction. The payment transaction is carried
out automatically by PayPal immediately thereafter. You will receive further information during
the order process.
PayPal may offer registered PayPal customers, selected according to its own criteria, further
payment options in their customer account. However, I have no influence on whether these
options are offered; any further individually offered payment options concern your legal
relationship with PayPal. You can find further information on this in your PayPal account.
Google Pay
To pay the invoice amount via Google Pay, you must be registered with the service provider
Google, have activated the Google Pay function, identify yourself with your access data and
confirm the payment instruction. The payment transaction is carried out immediately after you
place the order. You will receive further information during the order process.
Apple Pay
To pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with
the service provider Apple, have activated the Apple Pay function, identify yourself with youraccess data and confirm the payment instruction. The payment transaction is carried out
immediately after you place the order. You will receive further information during the order
process.
6. Retention of title
The product remains my property until it has been paid for in full.
7. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the delivery
person as soon as possible and contact me without delay. Failure to report the damage or to
contact me has no consequences for your statutory claims and their enforcement, in particular
your warranty rights. However, you help me to assert my own claims against the carrier or the
transport insurance.
8. Warranty and guarantees
The statutory warranty law applies.
Guarantees and customer service
Information on any additional guarantees that may apply and their precise conditions can be
found with the respective product and on special information pages in the online shop.
Customer service: Customer inquiries, complaints and objections can be addressed to me by
email at mel@beyondfluidart.com, via the contact form, or by phone at +43 677 64286507 on
working days from 09:00 to 15:00.
9. Copyright and usage rights
By purchasing, you acquire ownership of the delivered physical work. Copyright and usage
rights in the depicted work remain entirely with me.
In particular, the purchase does not entitle you to reproduce, edit, make publicly available or
commercially exploit the motif. Private use and resale of the acquired physical work remain
unaffected.
10. Presentation of the artworks
The images in the online shop reproduce the artworks as accurately as possible. Minor color
deviations between the screen display and the printed work are technically unavoidable and do
not constitute a defect.
Likewise, production-related deviations within customary tolerances may occur with fine art
prints.
The signature and edition number are applied by hand. Minor variations in their position and execution are therefore part of the work and do not constitute a defect.
11. Dispute resolution
I am willing to participate in an out-of-court dispute resolution procedure before a consumer
arbitration body. The competent body is Verbraucherschlichtung Austria, Flachgasse 30/2. OG,
1150 Vienna, Austria, www.verbraucherschlichtung.at
